Welcome to Happy Cheerful Puppies

Hi everyone, we are Happy Cheerful Puppies and we have 16 years of experience working with dogs and the puppies. We work with our adults everyday and the puppies as well. We breed for health and temperament. We try our best to make sure that our customers are getting healthy puppies.

We are Rob and Sue Miller and the dogs and puppies are our children. We have 2 horses named Cash, and Domino and we have some chickens as well. We have nieces and nephews that love to play with the puppies. We have a couple helpers that help us with the cleaning. We make sure the puppies are socialized which makes the transition to new homes much easier for the puppies.

PUPPY SALES CONTRACT©

This agreement entered into in Sugarcreek, Tuscarawas County, Ohio, and is acknowledged and affirmed as being a complete description of the terms and conditions of this sale. There are no oral promises or other terms.

SELLER AGREES

The above puppy is up to date on immunizations and has been wormed. A copy of the shot record, registration, and veterinary record will be supplied to Buyer upon delivery of the puppy.
At the time of sale, the puppy is considered as being sold as “pet quality” and in good health.
Seller offers no guarantees that disqualifying faults will not arise at a later date or that this puppy is suitable for the show ring or for breeding.


SELLER’S GUARANTEE

The puppy is guaranteed to be in good health at the time of delivery. A guarantee for two weeks from the date of purchase applies to life threatening virus or illness. In order for Buyer to take advantage of this guarantee, the Buyer must have the puppy examined by the Buyer’s
licensed veterinarian within two weeks of delivery. If a life-threatening virus or illness is present then the Buyer must return the puppy to the Seller within five days of the date of delivery together with a written statement from the veterinarian detailing the life-threatening virus or illness.
The puppy is guaranteed to be free from life-threatening genetic defects for one year from the date of birth. If the puppy is found to have a life-threatening genetic defect, Buyer must notify Seller within seven days of diagnosis and supply the Seller with the veterinarian’s written report.
The Seller reserves the right to have the diagnosis verified by a veterinarian of Seller’s choice.


BUYER’S REMEDIES

Buyer’s sole remedy under this contract is a refund of monies paid by the Buyer as set forth in this contract. The refund will be paid upon return of the puppy to the Seller. Further, Seller assumes no responsibility for the puppy after leaving the premises for any medical expense,

death, allergies, training difficulties, behavior issues, etc.

BUYER AGREES

Buyer agrees to have the puppy inspected by a state licensed veterinarian within two weeks of the date of delivery. Buyer also acknowledges that Buyer will supply the puppy with plenty of love, fresh water, quality puppy food, exercise, and a warm dry place to sleep. The puppy has had its current vaccination and worming. Future vaccinations and worming, including annual boosters, must continue on a regular basis.

EXCEPTIONS TO GUARANTEE

There is no guarantee to adult size, color, disposition, breed, temperament, hair texture, conformation dropping of testicles, or suitability to breed.
A diagnosis of cherry eye, coccidia, giardia, parasites, kennel cough, hypoglycemia, or any type of bacterial/viral infection does not render your puppy unhealthy. These items/germs can be found on the ground, in water, and public places. Parvo is also not covered by this contract/guarantee as the puppy has only been started on its inoculations prior to going to the new home and family. Your puppy’s immune system is not fully developed until he/she has completed its series of puppy shots.
We strongly urge you to take the following precautions:
1. Visits to the vet: Never put your puppy on the floor on the ground outside of the clinic.

Instead, carry your puppy or use a pet carrier. Ask the vet staff to disinfect the exam table before you set your puppy down. This may seem overly cautious, but there are a lot of sick animals that go to the veterinarian every day.

2. Dog parks, pet shops, puppy preschool, and areas where other dogs of unknown health may have visited should be off limits until your puppy has completed his/her series of puppy shots.
It is important for the good health of your puppy to complete the worming and vaccinations needed to ensure that your puppy continues to enjoy good health.


MISCELLANEOUS
This contract is not assignable by the Buyer except with the Seller’s written consent. The interpretation and enforcement of this agreement shall be governed by the laws of the State of Ohio, and any legal action instituted by the Buyer or Seller to enforce any term, condition, or clause of this agreement shall be filed in the appropriate court of Tuscarawas County, Ohio. Seller reserves the right to not sell a puppy to anyone if for some reason Seller is of the opinion that the completion of this transaction would not be a good match for one of their puppies. If that determination is made, Buyer’s deposit will be refunded, and this contract will be null and void.
This agreement has been read and fully understood by both parties hereto and by executing this agreement all parties agree that the terms and conditions contained herein are acceptable and binding on both Buyer and Seller.
